Since the publication of J. A. Hobson’s (1858–1940) Imperialism: A Study in 1902, the text has been studied—even celebrated—as a liberal or proto-Marxist critique of modern empires. This reputation stands in some tension with the text itself, which defends various forms of imperial domination. While scholars have addressed this tension, they remain divided over how best to understand Hobson’s imperial commitments. Offering a new response to this debate, I argue that a key dimension of Imperialism has been overlooked—namely, Hobson’s conception (...) of humanity as stratified into a hierarchy of racial “souls.” This deeply committed view of human difference undergirded Hobson’s arguments about the moral and practical limits of Western imperial power. This article shows how Hobson articulated imperialism as the “parasitic” rule of whites over the nonwhite world—the solution to which was not the rejection of empire but the reform of white imperial power in accordance with his normative vision of global racial hierarchy. This recovery reveals the redemptive critique at the core of Imperialism and enables us to more readily grasp the text as a form of imperial apologetics. The article concludes with the suggestion that Hobson is better understood not as a liberal- or socialist-imperialist but as a proponent of racial capitalism on a global scale. (shrink)

L. T. Hobhouse (1864–1929) is most familiar today as a leading theorist of British new liberalism. This article recovers and examines his overlooked commentary on the concept and rhetoric of race, which constituted part of his better-known project of advancing an authoritative account of liberal doctrine. His writings during and after the South African War, I argue, represent a prominent effort to cast liberalism as compatible with both imperial rule and what he called ‘the idea of racial equality’. A properly (...) liberal empire, he asserted, would dissolve the colour line. This article traces the arguments Hobhouse advanced to make this claim, and explores his motivations for doing so. I contend that Hobhouse drew on the idiom of race as a form of exclusionary rhetoric, to delegitimise rival accounts of liberal empire and to cast his own as properly cosmopolitan. This recovery, I suggest, offers payoffs for our understanding of both Hobhouse's political thought and, more broadly, the uses of ‘race’ in twentieth-century liberalism. (shrink)

Live donor kidney transplantation is the best treatment option for most patients with late-stage chronic kidney disease; however, the rate of living kidney donation has declined in the United States. A consensus conference was held June 5-6, 2014 to identify best practices and knowledge gaps pertaining to live donor kidney transplantation and living kidney donation. Transplant professionals, patients, and other key stakeholders discussed processes for educating transplant candidates and potential living donors about living kidney donation; efficiencies in the living donor (...) evaluation process; disparities in living donation; and financial and systemic barriers to living donation. We summarize the consensus recommendations for best practices in these educational and clinical domains, future research priorities, and possible public policy initiatives to remove barriers to living kidney donation. In this paper we will show that Hempel's covering law model can't deal very well with explanations that are based on incomplete knowledge. In particular the symmetry thesis, which is an important aspect of the covering law model, turns out to be problematic for these explanations. We will discuss an example of an electric circuit, which clearly indicates that the symmetry of explanation and prediction does not always hold. It will be argued that an alternative logic for causal explanation is (...) needed. And we will investigate to what extent non-monotonic epistemic logic can provide such an alternative logical framework. Finally we will show that our non-monotonic logical analysis of explanation is not only suitable for simple cases such as the electric circuit, but that it also sheds new light on more controversial causal explanations such as Milton Friedman's explanation of the business cycle. Environmental ethics can be cultivated in China and other Asian countries based on Chinese philosophical perspectives. Two major Chinese philosophies relevant to the issues of environmental ethics—Confucianism and Taoism—suggest certain approaches to developing environmental ethics. These approaches can complement each other in developing a Chinese or East Asian theory of environmental ethics. Drawing on these perspectives, China’s Wolong National Nature Reserve can face the challenge of protecting its pandas while developing the local economy. By adopting a set of strategies with (...) elements from both Confucianism and Taoism, Wolong has fared well in both protecting pandas and promoting environmental ethics. Tianxia--conventionally translated as "all-under-Heaven"--in everyday Chinese parlance simply means "the world." But tianxia is also a geopolitical term found in canonical writings that has a deeper historical and philosophical significance. Although there are many understandings of tianxia in this literature, interpretations within the Chinese process cosmology generally begin with an ecological understanding of intra-national relations that acknowledge the mutuality and interdependence of all economic and political activity. This volume contextualizes the tianxia vision of geopolitical order within a variety of strategies (...) drawn from a broad spectrum of cultures and peoples: Buddhist, Islamic, Indian, African, Confucian, European. The conversation among the contributors is guided by several central questions: Is tianxia the only model of cosmopolitanism? Are there ideas and ideals comparable to tianxia that exist in other cultures? What alternative perspectives of global justice have inspired Western, Indian, Islamic, Buddhist, and African cultural traditions? The fundamental premise here is that in order for a planetary tianxia system to be relevant and significant for the present time and for our vision of the future, it must acknowledge the plurality of moral ideals defining the world's cultures while at the same time seek practical ways to formulate a minimalist morality that can provide the solidarity needed to bring the world's people together. Il continue à penser que rien ne pourra la remplacer, que la (...) paix des religions est une condition essentielle du développement du monde, et que la démocratie est source de trop d'illusions pour que l'on puisse en faire une manière de modèle platonicien, de validité planétaire. L'auteur a vu le pouvoir du virtuel menacer d'obsolescence le réel, qui pourtant permet encore de penser à un ordre créé, incontournable et incomparable. Il croit à des valeurs jugées obsolètes et ne craint de se faire juger de réactionnaire, car il admet qu'il n'y a de vrai progrès que là où de nouvelles forces sont puisées au fondement des choses. Çocuk evliliği, tarih boyunca farklı toplumlarda bilinen ve uygulanan sosyal bir olgu olsa da son zamanlarda, modern duyarlılıkları giderek daha fazla rahatsız eden bir hal almıştır. Son iki asır öncesine kadar, Avrupa hukuki düşüncesinde çocuklar yargı önünde farklı bir muamele görmelerine imkan veren istisnai bir statüye sahip değildi. Diğer taraftan, İslam hukukunun çocuklara, özel bir hukuki statü kazandırma konusunda bazı öncü adımlar attığını söyleyebiliriz. Nitekim, en eski İslam hukuku kitaplarının bile, insanın fiziksel ve zihinsel gelişim aşamalarına ve her bir aşamada (...) ortaya çıkan hukuki hükümlere dair son derece teknik ayrıntılarla dolu olduğunu görebiliriz. Ancak çocuk hakları konusundaki bu erken farkındalığa rağmen, çocuk evliliği olgusu hem İslam toplumlarında hem de İslam hukukunda kendini gösterebilmiştir. Çünkü, İslam çocuk hukuku, ilk ortaya çıktığı dönemin kültürel şartlarından ciddi şekilde etkilenmiştir. Üstelik bu kültürel şartlar, İslam dünyası boyunca İslam çocuk hukukunun temel zemini olma işlevini sürdüre gelmiştir. Bu çalışma, alimlerin çocuk evliliğini delillendirmek üzere yapageldikleri bazı aşırı yorumları ortaya koymaya ve konuyla ilgili âyetleri metinsel bağlamıyla daha uyumlu bir şekilde okumaya çalışmaktadır.Özet: Her bağlam için geçerli olabilecek, standart bir çocuk tanımı yapmak göründüğünden daha güçtür. Bu nedenle çocuk araştırmaları sahasında çalışan akademisyenlerin, muhtelif sosyal disiplinler tarafından yapılacak herhangi bir çocuk tarifi konusunda memnuniyetsizlik içinde olması doğaldır. Diğer yandan, İslam hukukunda baştan beri ayrıntılı bir çocuk hukuku teorisi mevcuttur. İslam hukuk düşüncesinde, insanlar doğum ile yetişkinlik arasındaki gelişim döneminde üç aşamadan geçerler: Çocukluk (küçüklük), buluğ ve rüşt. Bütün fıkıh mezhepleri, insanın doğumu ile ergenliği arasındaki dönemde küçük çocuk sayılacağı kanaatindedirler. Bu çocukların mallarının en iyi şekilde idare edilebilmesi için yasal temsilcileri bulunmak zorundadır. Fakîhler çocuğun velisinin, özellikle de baba veya baba tarafından dedenin, velâyeti altındaki küçük çocuklar üzerinde mücbir bir yetkisi olduğu (velâyet-i mücbire) konusunda geniş bir fikir birliğine sahiptirler. Buna göre veliler, velâyetleri altında bulunan çocukları uygun gördükleri kişilerle evlendirme yetkisine de sahiptirler. Fakat zaman zaman beşik kertmesi olarak da anılan bu uygulama bir ön sözleşmeden ibarettir. Yani bu sözleşme doğrudan doğruya fiziksel boyutları da olan müşterek bir evlilik hayatını meşru kılmamaktadır. Çünkü cinsel hayatın ancak buluğdan sonra gerçekleşmesi ön görülmektedir. Modernite öncesi İslam tarihi boyunca, İbn Şubrume (ö. 144/761), Ebû Bekr el-Esamm (ö. 200/816) ve Osman el-Bettî (ö. 143/760) gibi bir kaç fakih dışında küçük çocukların evlenmesine kategorik olarak karşı çıkan kimselere pek rast gelinmemektedir.Hanefi mezhebinde, herhangi bir zihinsel özrü olmaksızın buluğa eren erkek ve kız çocuklar evlilik konusunda mücbir velâyetin kapsamı dışına çıkarlar. Bu, evlilik sözleşmelerini bizzat gerçekleştirebilecekleri anlamına gelmektedir. Fakat veli, uygunsuz bulduğu evliliğe karşı dava açarak bunu yargı yoluyla geçersiz kılma yoluna gidebilir. Diğer üç Sunnî mezhep ise erkek ve kız çocuklar arasında bir ayrım yapar: Buluğa eren erkek kendi evlilik akdini yapabilme hakkını elde ederken aynı durumdaki kız çocuklar velâyet altında kalmaya devam ederler. Şâfiʿî mezhebine göre, velâyeti gerekli kılan illet (bekaret) hâlâ geçerliliğini korumaktadır. Dolayısıyla veli, kızları evlendirme konusundaki icbâri yetkisini elinde tutmaya devam etmektedir. Bu durumda kızın rızasının alınması, akdin geçerliliği için şart olmaktan ziyade sadece nezaket gereğidir. Rüşte ulaşmak veya fizyolojik olgunlaşma sürecini tamamlamak ise İslam hukukunda evlilik için şart görülmemiştir.Modern zamanlara kadar geleneksel İslam hukukunun erken evlilik lehinde gösterdiği bu yaklaşımda herhangi bir değişiklik olmamıştır. 1917 yılında çıkan Hukuk-ı Aile Kararnamesi daha önce benzeri görülmemiş bir dizi düzenleme getirmiştir: İlk olarak, evlilik yaşı erkek için on sekiz kız için ise on yedi olarak belirlenmiştir. On sekiz yaşın altındaki erkeklerin hakimden evlenme izni alması; on yedi yaşından küçük kızların ise hem veli onayı hem de hakim iznine sahip olması zorunlu hale getirilmiştir. On iki yaşın altındaki erkekler ile dokuz yaşından küçük kızların ise asla evlendirilemeyeceği kararlaştırılmıştır.Mantıkî bağlam ve sentaktik yapı elverişli olmamasına rağmen fakihler çocuk evliliğini desteklemek üzere bazı Kur’ân âyetlerine (Nisâ 4/3-6, Nisâ 4/127, Talâk 65/4) referansta bulunmuşlardır. Makale içeriğinde detaylı şekilde açıklandığı üzere zorlama yorumlamalarda bulunmuşlardır. Bu makale, söz konusu âyetlere daha tutarlı bir yorum getirmeye çalışmaktadır. Aynı şekilde, Kur’an’ın çocuk evliliğini kolaylaştırıcı bir tavır içerisinde olmadığını, çocukların evlendirilebilmesi yönündeki yaklaşımların tarihsel ve kültürel şartlara bağlı olarak yapılan bazı zorlama yorumlara dayandığını ileri sürmektedir.Hz. ʿÂişe’nin Hz. Peygamber ile oldukça erken bir yaşta evlendiğine dair nakledilen rivâyet de konuyla ilgili olarak ileri sürülen başka bir argümandır. Bu rivâyetin sahih olduğuna inanılmaktadır. Buna rağmen ilginç bir şekilde bu rivâyet çok az fakih tarafından kullanılmıştır. Bunun sebebi, fakîhlerin Hz. Peygamberin mahremiyetinden bahsetmek istememeleri olabilir. Rivâyetin hücciyeti konusuna kuşkuya kapılmış olmaları da mümkündür. Söz konusu rivâyete daha yakından bakıldığında, ifadedeki menfi üslup hemen dikkat çekmektedir. Çünkü rivâyette Hz. ʿÂişe, Hz. Peygamberle evlendiği günü anlatırken sürekli olarak fizyolojik ve psikolojik açıdan olumsuz koşullardan bahsetmektedir. Nitekim Hz. ʿÂişe birden bire oynamakta olduğu salıncaktan alınmakta ve kendisinin de bilmediği bir yere doğru götürülmektedir. Rivâyet, sadece çocuk evliliğinin cevazını ortaya koymakla yetinmemekte, sanki aynı zamanda çocukların uygunsuz koşullardaki evlilik taleplerine bile itaatkar olmaları gerektiğini salık vermektedir. İçerik yanında teknik olarak bakıldığında bu rivâyet, haber-i vâhiddir. Çünkü rivâyet, sadece Hz. ʿÂişe tarafından bilinebilecek detayları içermektedir. Tarihî açıdan bir öneme sahip olmasına rağmen dinî hükümlere kanıt olma niteliğinden yoksundur. Çünkü bu rivâyette, râvi konuyla ilgili Hz. Kant, bir 18. yüzyıl filozofu olmasına karşın, görüşleri kendi döneminde olduğu kadar sonraki yüzyıllarda da yankı uyandırmış ve birçok kişiye ilham kaynağı olmuştur. Kant’ın ahlak felsefesi üzerinden yürüttüğü tartışmalar, onun siyaset felsefesi de dahil olmak üzere tüm felsefesinin mihverini oluşturmuştur. Kant’ın birey odaklı felsefesi, bir yandan liberal ideolojinin takipçileri arasında tartışma konusu olurken, diğer yandan da 19. yüzyılın ikinci yarısından itibaren sosyal demokratlar arasında tartışmalara konu olmuştur. Almanya’da Lassalle’le başlayan bu tartışmalar, Fabian Hareketi’yle sürmüş ve Bernstein’le doruk noktasına ulaşmıştır. Bu (...) hareketler, Ortodoks Marksizmden koptukça daha etik merkezli bir noktaya evrilmiş ve adeta neo-Kantçı bir projeye dönüşmüştür. Bu dönüşümü besleyen ve sosyal demokrat revizyonizmin temellerini oluşturan tartışmaysa Bernstein ve Kautsky arasında yaşanmıştır. Kant ve Marx’ın ahlak anlayışlarını mevcut toplum üzerinden tartışan ikili, buradan sosyal demokrasiye bir gelecek planı, iktidar stratejisi ve toplum tahayyülü de çıkarmak için çabalamışlardır. Bir yandan daha muğlak bir ahlak tanımı olan Marx’ın ve dolayısıyla Marksizmin ahlak görüşleri iki tarafından yorumlanırken, diğer yandan da Kant’ın ahlak anlayışının sosyal demokrasideki rolünün ne olması gerektiği tartışılmıştır. Bu bağlamda bu çalışma, öncelikle Kantçı ve Marksist ahlak anlayışlarını karşılaştırarak birbirinden ayrıldığı noktaları gözler önüne sermiştir. İç mekanlar genellikle binaların içi olarak düşünülür ve söz konusu bir dış mekan olduğunda, bu mekanın ―içerisi‖ olarak düşünülemeyeceği varsayılır. Dışarısı asla tam olarak bir iç mekan değildir. Bu makalede, bu görüş problematize edilmiş ve ―dışarının‖ da bir ―içerisi‖ olarak deneyimlenip deneyimlenemeyeceği araştırılmıştır. İlk olarak mekan sorununu ve bunun insan ile karşılıklı ilişkisini ele (...) alındı. Mekanı deneyimleme şekillerimiz ve bunların insan bedeni ve duyularıyla özsel ilişkisi içerinin ve dışarının anlamını tanımlamada bir zemin oluşturdu. Subjects enrolled in studies testing high risk interventions for incurable or progressive brain diseases may be vulnerable to deficiencies in informed consent, such as the therapeutic misconception. However, the definition and measurement of the therapeutic misconception is a subject of continuing debate. Our qualitative pilot study of persons enrolled in a phase I trial of gene transfer for Parkinson disease suggests potential avenues for both measuring and preventing the therapeutic misconception. Building on earlier literature on the topic, we developed and (...) tested an interview guide that focuses on how the subjects decided to participate, emphasizing the integration of subjects’ various statements that are relevant to assessing the therapeutic misconception, rather than evaluating them as isolated statements. The results indicate that a subject’s understanding of the purpose of research is best explored in juxtaposition to the subject’s motivation for participating. (shrink)

By comparing mechanisms in nativism, empiricism, and culturalism, the target article by Steels & Belpaeme (S&B) emphasizes the influence of communicational constraint on sharing color categories. Our commentary suggests deeper considerations of some of their claims, and discusses some modifications that may help in the study of communicational constraints in both humans and robots.

I identify three functions of language: the communicative, the objectifying, and the objective. I claim that of these three functions, the objective function is the most essential, in the sense specified in the paper, and the communicative the least. I further indicate that language use without the communicative function is more prevalent than might commonly be believed.

This paper offers an alternative view of spacetime different from both substantivalism and relationism. Using basic ideas underlying the fiber bundle formulation of field theories, it illustrates the function of spacetime in individuating local fields. As the system of numerical identities for entities that we can individually refer to, spacetime is an intrinsic, indispensable, and inalienable structure of the physical world with distinct entities.

Background: Financial conflict of interest in clinical research is an area of active debate. While data exist on the perspectives and roles of academic institutions, investigators, industry sponsors, and scientific journals, little is known about the perspectives of potential research participants.Methods: The authors surveyed potential research participants over the internet, using the Harris Interactive Chronic Illness Database. A potential research participant was defined by: self report of diagnosis by a health care professional and willingness to participate in clinical trials. Email (...) invitations were sent to 20 205 persons with coronary artery disease, breast cancer, or depression; a total of 6363 persons were screened; of these, 86% or 5478 met inclusion criteria and completed the survey. The outcome measures were respondents’ ratings on: importance of knowing conflict of interest information, whether its disclosure ought to be required, and its effect on willingness to participate—across seven widely discussed scenarios of financial conflicts of interest .Results: Majority responded that knowing conflict of interest information was “extremely” or “very” important; a larger majority felt financial conflicts of interest should be disclosed as part of informed consent . In all seven scenarios, a majority was still willing to participate but in some scenarios a sizable minority would be wary of participation. Respondents were more wary of individual than institutional conflicts of interest. Illness group and sociodemographic factors had modest effects and did not affect the main trends.Conclusions: The prevailing practice of non-disclosure of financial conflicts of interest in clinical research appears contrary to the values of potential research participants. I det dominerande tankemønsteret i grunnskulelærarutdanninga er det konstruert ei motsetning mellom vitskapleg kunnskap og erfaringskunnskap. Vitskapleg kunnskap vert skildra som noko positivt, medan erfaringskunnskap får ei negativ omtale. Dette filosofiske essayet vil framskrive ei re-oppfatning av denne dikotomien. Målet med arbeidet er å redusere dikotomien mellom desse to kunnskapsformene og vise ei forståing som er meir jambyrdig, og som samlande kan bli kalla for lærarens levande kunnskap. Teorien om levande kunnskap (...) tar utgangpunkt i mennesket si heilskapande erkjenningsevne. Mennesket sin kognitive kapasitet inneheld både rasjonelle, etiske, emosjonelle og motoriske erkjenningar. This essay is an attempt to participate in a discussion about metaphysics today. I claim that metaphysic now seems silenced or taken for granted. Machiavelli’s idea of fortuna or fate represents question and perception that cannot be recognized empirically. My aim is to place Machiavelli into an ongoing discussion about the distinction between nature and culture and perception of reality as organic or harmonic. As part of this, I will discuss fortuna’s place in modern research based teacher education, which places (...) our fate in the hand of science, the institutionalization of learning and the lack of virtue. In conclusion, I wish to express some critical remarks on this development, not taking into account the metaphysical speculation. (shrink)

The main object of this article is to contribute to a clearer use of the concept reflection. The question is whether reflection has become an overexposed and diluted medicine in educational thinking. To answer this question I will examine how reflection is understood and what direction and theoretical foundation the concept is based on. The article is a Habermas inspired interpretation of basic textbooks for teacher education. In the textbooks, reflection is presented as a good medicine for the professional teacher (...) and a continuous reflection will improve the professional practice by developing consciousness in action. In the conclusion I will present some recommendations on how to improve the understanding and use of reflection. My main goal is to provide reflection with a theoretical content and a clearer direction. Reflection is a knowledge searching, which is not based on experience and facts, but which is closely tied to philosophical thinking, critical theory and the ability to develop an overview. (shrink)

The purpose of this paper is to reflect on how the Corona pandemic might influence human understanding of our position of being in the world. In the first part of the paper, we present how a pandemic can be under- stood in relation to our society and our educational system. Then, we will present problems and questions highlighted by the pandemic and the kind of transformations needed to address these problems. The core ele- ments that require transformation are the understanding (...) of the essence of man or the human condition, the understanding of what caring for nature and even a pandemic means, and how to measure human action and values. Esta colección de ensayos o «ejercicios de precisión conceptual» intenta aportar alguna claridad en el tratamiento de cuestiones de relevancia político-moral como el concepto de tolerancia, el significado moral del concepto de dignidad humana, la calamidad moral del Holocausto, la respuesta a la violencia extraordinaria, la fundamentación racional de las normas morales, lo íntimo, lo privado y lo público, hipocresía, simpatía y Estado de derecho o pluralismo, diferencia y desigualdad. Se presentan como «propuestas» que no pretenden ser «verdaderas» sino tan (...) sólo «plausibles», en consonancia con la comprensión que del trabajo intelectual tiene el autor, al que le importa expresar reflexiones que permitan esquivar el dogmatismo y estimular la saludable duda. Pero estas propuestas no penden en el aire, sino que se apoyan en presupuestos kantianos y democrático-liberales. Tienen un carácter cuasi normativo en el sentido de que aspiran a ser compartidas no sólo en el plano de la teoría sino también en los correspondientes cursos de acción. Se trata de una obra, además, escrita desde la convicción de que «conviene no despreciar la ayuda del poeta: las creaciones intelectuales no surgen ni se mantienen aisladas; todas ellas se integran en lo que llamamos cultura. Esto vale también para el caso del derecho». Al abrir así el campo de las cuestiones jurídico-morales a un público más amplio que el especializado, estas Propuestas representan una introducción idónea al mundo del derecho. (shrink)

Let n ≥ 3 be an integer. We show that it is consistent that every σ1n-set of reals is universally Baire yet there is a projective well-ordering of the reals. The proof uses “David’s trick” in the presence of inner models with strong cardinals.
